  2. Use of the Website is offered to you conditioned on acceptance without modification of all the terms, conditions and notices contained in these Terms, as may be posted on the Website from time to time. Lastinch.in at its sole discretion reserves the right not to accept a User from registering on the Website without assigning any reason thereof.

User Account, Password, and Security:

You will receive a password and account designation upon completing the Website’s registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) notify immediately lastinch.in of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Lastinch.in cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

Services Offered:

Lastinch.in provides a number of Internet-based services through the Web Site (all such services, collectively, the “Service”). One such service enables users to purchase original merchandise such as clothing, footwear and accessories from various fashion and lifestyle range. (collectively, “Products”). Upon placing an order, lastinch.in shall ship the product to you and be entitled to its payment for the Services.

Privacy Policy:

The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of lastinch.in the Website. The user further consents that the terms and contents of such Privacy Policy are acceptable to him.

User Conduct and Rules:

Moreover, we might refuse any of our services, terminate accounts, and/or cancel orders at our discretion, including but not limited to, if we believe that customer conduct violates applicable law or is harmful to our interests.
  12. you shall not make any derogatory, defamatory, abusive, inappropriate, profane or indecent statement/s and/or comment/s about lastinch.in, its associates and partners on any property owned by lastinch.in.

No Compensation Policy:

If the quality of any products, services, information, or other material purchased or obtained by you through the Website did not meet your expectations, no compensation will be given other than the Return and refund or Exchange of the product. The customer cannot request compensation for any reason, including but not limited to: any variation in the finish or appearance of the final product; any delay in delivery caused by unforeseen circumstances; any special, incidental, indirect or consequential damage of any kind caused by a product; missed opportunities to avail certain discounts; any issue with our Delivery partners or their personnel; any voucher which got deactivated due to the end of expiry date; unavailability of items which the customer tried to purchase etc. Unreasonable and unlawful requests for compensation, over and above the entitled refund, will be treated as loss to business cases. LASTINCH holds the right to cancel orders and block accounts of such customers without any prior notice.

User Warranty and Representation:

The user guarantees, warrants, and certifies that you are the owner of the content which you submit or otherwise authorized to use the content and that the content does not infringe upon the property rights, intellectual property rights or other rights of others. You further warrant that to your knowledge, no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name service mark, and copyright formerly or currently used by you in connection with the Services rendered by lastinch.in.

Exactness Not Guaranteed:

Lastinch.in hereby disclaims any guarantees of exactness as to the finish and appearance of the final product as ordered by the user. The quality of any products, services, information, or other material purchased or obtained by you through the Website may not meet your expectations. Alterations to certain aspects of your order such as the merchandise brand, size, colour etc. may be required due to limitations caused by availability of product difference in size charts of respective brands etc. In this instance you agree that a representative from lastinch.in will call you or send an approval request via the email address which you submitted when placing your order. If you do not agree with the requested change you retain the right to reject the requested production change by replying to it within 7 days of it being sent to you. Lastinch.in may re-request that you accept a production alteration one additional time if an alternative method to send your merchandise is available. If you reject this 2nd request, your order will be cancelled and you will be fully refunded via your initial method of payment.

Intellectual Property Rights:

Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, lastinch.in owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. Indemnification:

You agree to indemnify, defend and hold harmless lastinch.in from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by lastinch.in that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to these Terms.

Pricing:

Prices for products are described on our Website and are incorporated into these Terms by reference. All prices are in Indian rupees. Prices, products and services may change at lastinch.in discretion. Taxes will always be applicable on every purchase as per Government norms.

Usage of Pay U services and its charges

If the customer opts to choose the PayU Services Product PayU Money, then it shall be bound by the PayUMoney terms and condition at http://www.payumoney.com/termsandconditions.html

The customer further agree and undertakes to pay the charges/ commission, if any, so charged by PayU Money for the providing its services PayU Services Product PayU Money.

Shipping:

Title and risk of loss for all products ordered by you shall pass on to you upon lastinch.in shipment to the shipping carrier.

Delivery:

Lastinch.in will make a maximum of two attempts to deliver your order. In case the customer is not reachable or does not accept delivery of products in these attempts, lastinch.in reserves the right to cancel the order(s) at its discretion.

An estimated delivery time is communicated with shipment tracking details. Standard delivery time for metro cities and other rural areas with good connectivity via Air route may be 6 – 7 working days. On placing your order, you will receive an email containing a summary of the order.

Sometimes, delivery may take longer due to:-

  1. bad weather
  2. flight delays
  3. political disruptions
  4. other unforeseen circumstances

Also, we will not be able to compensate for any mental agony caused due to delay in delivery. The customer can cancel the order at any moment of time even if the delivery time exceeds the expected time. In case the order remains unprocessed or undelivered the order will be automatically cancelled and refunded in their respective account if prepaid or in the form of LASTINCH credit points.

“The Buyer agrees that the title to the goods is transferred to the buyer at the time of placing the Order and dispatch confirmation thereof irrespective of Shipping of Goods and COD which are to be done in due course being a separate chargeable facilities”

Post Delivery:

Returns conditions & Policies:

Lastinch.in will accept Return only if the following conditions are met other return policies are mentioned here.

  1. The tags on the product should be intact.
  2. The product should be unwashed, unused and in an undamaged condition.
  3. The item needs to be returned along with the original packaging.
  4. All the products are eligible for return on the website except the products tagged under category Factory Outlet , Clearance Sale , Beauty , Personal Hygiene , Face Mask  & Lingerie.
  5. The products purchased on Factory Outlet , Clearance Sale cannot be returned, exchanged or refunded under any circumstances.
  6. The refund amount will be credited back to your LASTINCH account in the form of a voucher or credit points for future purchases.
  7. The process of credit of account, in case of return of product, will take a period of 3-4 working days, in case the account is not updated the customer can contact by email on support@lastinch.in to state his/her grievance.
  8. The offers applicable on site would vary time to time and would be in accordance with the respective promotional conditions like student discounts which would be subjected to the presentation of a valid student id card. Coupon discounts can be for a limited period or for unlimited period but can only be used once by every user registered with their respective ids. Site would give coupon discounts valid as per product discount or cart discount, product discounts would be applicable on products defined to the respective coupon and cart discount would be applicable on total cart price after applying a coupon code.
  9. Reverse pick up services are subjected to the serviceability of the courier partners.
  10. Returns would be valid only on fresh purchases within 10 days post delivery.
  11. COD & shipping charges are non refundable.

Gift Vouchers:

  1. Gift vouchers can be redeemed against all products only at www.lastinch.in
  2. Gift voucher can only be redeemed once.
  3. Gift voucher is valid for 12 months from date of issue. Unused values will not be refunded or attributed to any transactions after the expiry date.
  4. Gift vouchers cannot be redeemed for cash, returned for a refund, have their balances consolidated to a new voucher or be replaced after expiry and are not legal tender, account cards, credit or debit cards or securities.
  5. If your purchase exceeds the value of the gift voucher, balance must be paid by cash, debit or credit card.
  6. If you return any products you have purchased using a gift voucher, the balance will be credited to you as a credit note and is to be redeemed against subsequent purchases.
  7. Gift vouchers cannot be replaced if lost or stolen.
  8. Lastinch reserves the right to cancel a gift voucher if we deem such action necessary. If so, we may either provide a replacement gift voucher of equivalent value unless we suspect fraud in relation to a gift voucher. The gift voucher remains our property.
  9. Lastinch can vary or replace these conditions from time to time (including to introduce new fees if required).

Termination:

  1. Lastinch.in may suspend or terminate your use of the Website or any Service if it believes, in its sole and absolute discretion that you have breached any of the Terms.
  2. If you or lastinch.in terminates your use of the Website or any Service, lastinch.in may delete any content or other materials relating to your use of the Service and lastinch.in will have no liability to you or any third party for doing so.
  3. You shall be liable to pay for any Service or product that you have already ordered till the time of Termination by either party whatsoever. Further, you shall be entitled to your royalty payments as per the User License Agreement that has or is legally deemed accrued to you.

Governing Law:

These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts at New Delhi.

Headings:

The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of the Terms or the right to use the Website by you contained herein or any other section or pages of the Website or any Linked Sites in any manner whatsoever.

Interpretation of Number And Genders:

The Terms herein shall apply equally to both the singular and plural form of the terms defined. Whenever the context may require, any pronoun shall include the corresponding masculine and feminine. The words “include”, “includes” and “including” shall be deemed to be followed by the phrase “without limitation”. Unless the context otherwise requires, the terms “herein”, “hereof”, “hereto”, “hereunder” and words of similar import refer to the Terms as a whole.

Severability:

If any provision of the Terms is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceable shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of these Terms shall continue to be in full force and effect.

Report Abuse:

As per these Terms, users are solely responsible for every material or content uploaded on to the Website. Lastinch.in does not review the contents in any way before they appear on the Website. Lastinch.in does not verify, endorse or otherwise vouch for the contents of any user or any content generally posted or uploaded on to the Website. Users can be held legally liable for their contents and may be held legally accountable if their contents or material include, for example, defamatory comments or material protected by copyright, trademark, etc. If you come across any abuse or violation of these Terms, please report to support@lastinch.in.

Unauthorized Charges on your card

If you see charges on your credit/debit card for purchases made on lastinch.in, but you never created an account or signed up, please check with your family members or business colleagues authorized to make purchases on your behalf, to confirm that they haven’t placed the order. If you’re still unable to recognize the charge, please report the unauthorized purchase within 60 days of the transaction to enable LASTINCH to begin an investigation.

Cancellation of Fraudulent/Loss to business Orders

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, lastinch.in reserves the right to cancel all past, pending and future orders without any liability. lastinch.in also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website and stock unavailability. We may also require additional verification or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your card has been charged, the said amount will be reversed to your Card Account. Any promotional voucher used for the cancelled orders may not be refunded.

The customer may be considered fraudulent if any of the following scenarios are met:

  1. Customer doesn’t reply to the payment verification mail sent by LASTINCH
  2. Customer fails to produce adequate documents during the payment details verification
  3. Misuse of another customer’s phone/email
  4. Customer uses invalid email and phone no.
  5. Overuse of a voucher code
  6. Use of a special voucher not tagged to the email ID used.
  7. Customer returns the wrong product
  8. Customer refuses to pay for an order
  9. Customer is involved in the snatch and run for any order

Product Review Guidelines

  1. Brisk and effective content: It is advisable that the content of the review is honest, simple, to-the-point and helpful in the interest of future buyers of the same product. Keep in mind that your review is based on your personal experience of your product choice, timing of the order and demographic contours. It is important that you set a clear and realistic picture in your review for other future buyers to follow suit.
  2. Content of the review: The review section in essence is limited to only issues with respect to the product like the quality, comfort level, colour, size etc. Please note that reviews written with irrelevant content referring to another product or company will not be published.
